General Terms and Conditions of Business and Transport

1. Tandem-Paragliding-Berchtesgaden.de is an association of independent pilots who all operate independently and on their own account.

2. The passenger expressly declares that he/she is in good physical health. In particular, he/she declares that he/she has no heart or circulatory diseases or balance disorders and feels able to cope with the stresses of flying. If there is any uncertainty about their fitness to fly, the passenger is obliged to have this fitness confirmed by a doctor. They undertake to cancel the flight if they have not understood all or part of the pilot’s theoretical briefing, or if they are under the influence of alcohol, drugs or medication.

3. Passengers undertake to wear appropriate clothing (long trousers and jacket) and sturdy shoes (covering the ankles)..

4. The passenger undertakes to follow the pilot’s instructions. The passenger will receive a briefing before take-off. Failure to follow instructions during take-off, flight and landing may endanger the passenger and pilot. In the event of non-compliance, the pilot may exclude the passenger from the flight and the right to carriage shall expire without any claim for a refund of the flight fee..

5. By placing an order for a flight or voucher, the customer is bound to pay the flight price. The flight price is payable without deduction. The fee is payable in cash or via PayPal after the flight has been completed. Vouchers must be paid for within 7 days of receipt. Vouchers are valid for 3 years after the year of issue. When ordering vouchers, please note that thermal flights cannot be 100% guaranteed in all cases due to weather conditions. We always do our utmost and take this into account when arranging appointments, but please note that no refunds can be given for vouchers paid for in advance.

6. The cost of cable car rides is not included in the flight fee.

7. When booking a passenger flight or purchasing a voucher, you have the right to cancel up to 14 days after booking confirmation or receipt of payment. Cancellation after this period is not possible. If you cancel within the cancellation period, all costs will be refunded..

8. Cancellation of a fixed appointment by the passenger, by email or verbally, up to 4 days before the scheduled flight is free of charge. From 3 days to 24 hours before the flight, a cancellation fee of 50% of the basic tandem flight price will be charged. Cancellations within 24 hours of the agreed date will be charged at 100%. Vouchers lose their validity until the cancellation fee has been paid.

9. The pilot determines the details of the flight. The pilot may cancel the flight if he considers the passenger unsuitable or if he considers the external conditions (weather, wind, terrain) unsuitable. We expressly point out that, despite firmly agreed dates, there is no entitlement to transport if weather conditions do not permit it. In the event of postponement or cancellation, there is no entitlement to compensation, refund or reimbursement of other expenses incurred. The entitlement to a make-up flight/replacement date remains.

10. The flight duration depends largely on weather conditions. The flight times listed for each offer are approximate. For the “Thermal Flight” offer, the base price includes a flight time of approximately 30 minutes. This price increases by €30 for flight times exceeding approximately 50 minutes.

11. The respective pilot provides insurance cover within the scope of the prescribed liability insurance. In addition to the statutory liability insurance for personal injury and property damage, passenger accident insurance covers passenger damages (such as injuries, loss of earnings) in the event of pilot error up to an amount of €2.5 million, and up to €122,000 in the event of no fault on the part of the pilot. There is an express exclusion of liability for claims exceeding the statutory coverage amounts.

12. We expressly point out that participation in flight operations may pose an increased risk to the health, life and property of passengers! Especially during take-off, we are moving in alpine terrain. Pilots cannot be held liable for damage to items carried, e.g. mobile phones, glasses or cameras.

13. Right to use image and film material: The passenger agrees to the use of film and photo recordings made by the pilot during the flight for marketing purposes..

14. Should any part of any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions. An invalid provision shall be replaced by a provision that comes closest to the original provision.

15. By placing a transport order, either verbally or via our website, or by redeeming a voucher, the passenger has accepted the General Terms and Conditions. If the person ordering a flight passes on the flight or a voucher to another person, they must inform them of our General Terms and Conditions. In the case of underage passengers, the booking and thus also acceptance of the General Terms and Conditions is made by a legal guardian.
